Boy dies days after being shot in head by brother with uncles gun, sheriff says

On a Monday afternoon, eight people were at a suburban home west of Houston when three young children were playing around. That’s when they found a pistol, owned by their uncle. When they handled the pistol out of curiosity, a 9-year-old boy accidentally discharged the weapon, striking his 4-year-old brother.  Police from the Harris County Sheriff’s Office have arrived at the scene after receiving a call at about 12.20 pm, with people from nearby homes observing the scene; although, the incident may have occurred well before 12pm, as deputies have wondered why people haven’t contacted 911 in an instant. The 4-year-old boy was taken to Memorial Hermann Katy, where he was flown by Life Flight to a hospital in the Texas Medical Center. 

On Thursday, Sheriff Ed Gonzalez said he had died.

The pistol was found to be owned by 32-year-old Francisco Javier Lupian, the uncle to the wounded 4-year-old boy and his 9-year-old brother. Lupian faced a felony charge for evading arrest in Colorado County back in 2012; he served three years in prison. Lupian, who taught his 9-year-old nephew how to “pull the slide on the firearm”, is charged with “possession of a firearm by a convicted felon”; his bond is set at $100,000.
